Terms of Service

These Terms govern your use of the Coldloads dispatch service (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and authorised to act on behalf of the trucking or dispatching organisation whose Gmail or Telegram account you connect to the Service.
2. Your account
- You sign in via Google. The email address Google returns becomes your account identifier.
- You are responsible for activity under your account, including any messages composed or sent through the Service.
- If you connect Gmail or Telegram to the Service, you affirm you are authorised to grant that access.
- You may withdraw OAuth consent or revoke Telegram session at any time, which removes our ability to act on your behalf.
3. Acceptable use
You agree not to use the Service to:
- Send unsolicited bulk messages (spam) over Gmail, Telegram, or any connected channel
- Send messages that violate the Telegram Terms of Service or Google Workspace Acceptable Use Policy
- Impersonate another person or entity
- Distribute malware, conduct phishing, or run any other malicious activity
- Attempt to access another user's data, gain unauthorised access to the Service infrastructure, or probe the system in ways that could degrade availability
- Reverse-engineer, decompile, or scrape the Service
4. Your data, your responsibility
You retain ownership of all data you upload, paste, or have ingested through your connected accounts. You grant us a limited, non-exclusive licence to process that data solely to operate the Service for you.
You are responsible for:
- The legality of the broker contacts and email content you handle through the Service
- Backing up data outside the Service if you require additional redundancy beyond ours
- Keeping your authentication factors (passwords, TOTP devices) secure
5. Service availability
The Service is provided on a best-effort basis. We may experience downtime for maintenance, infrastructure failures, or third-party API outages (Google, Telegram, Anthropic). We do not provide a contractual SLA at this time.
6. Pricing
The Service is currently free during early access. We reserve the right to introduce paid tiers in the future, in which case pricing will be communicated in-app at least 30 days before any charge applies.
7. Termination
- You may stop using the Service and delete your account at any time by writing to [email protected].
- We may suspend or terminate accounts that violate these Terms, that abuse the third-party APIs we depend on, or that we reasonably suspect to be compromised.
- On termination, we delete your account directory and Supabase rows within 30 days. Encrypted backups age out within their retention window (typically 14 days locally, weekly Hetzner snapshots).
8. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that load matches will be commercially viable, that messages will be delivered on time, or that the Service will be uninterrupted or error-free.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, COLDLOADS AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR LOADS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
10. Indemnification
You agree to indemnify and hold the Service operator harmless from any claim, loss, or expense (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms.
11. Changes to these Terms
We may update these Terms. The "Last updated" date at the top reflects the most recent change. Material changes will be posted in-app at first login after the change. Continued use of the Service after a change constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the operator's place of residence, without regard to conflict-of-laws principles. Any dispute that cannot be resolved by good-faith negotiation shall be subject to the exclusive jurisdiction of the competent courts there.
